This Privacy Policy, with an effective date of December 2010, covers the treatment of personally identifiable information by Atlantic Diving Supply, Inc. (“ADS”, “we” “us” or “our”), collected online or on the website,, or any subdomain thereof, (“Site”) from time to time, including without limitation, when you: (1) register or apply for an online account, (2) complete the ADS CONTACT FORM, (3) request a catalog, (4) access the Site online, (5) sign up for our newsletter, (6) or otherwise request information about products or services from ADS electronically (collectively, “Online Activities”). This policy also covers the treatment of any personally identifiable information that any ADS business partners may share with ADS. This policy does not apply to the practices of companies that ADS does not own or control, or to people that ADS does not directly employ or manage.

ADS is the sole owner of the information collected on this Site. ADS collects personally identifiable information from its users at several different points on its Site. ADS does not sell or share personal customer information in any form with any outside company or organization unless required by law. ADS will not sell your personal information to any third party, without your prior consent.

The Site or ADS may collect personal information during your Online Activities. Non-Personal identifying information may be used to assist us with future marketing placement.

We will not sell or rent your personal identifiable information to anyone. We may share personal identifiable information about you to other companies or people when ADS: (1) must respond to subpoenas, court orders or legal process, (2) finds that your actions on the Site violate the Site’s Terms of Use, (3) has your consent to share the information, (4) needs to share your information to provide the information, newsletter, product or service you have requested, or (5) needs to send the information to companies who work on behalf of ADS to provide information, products or services to you. Unless we tell you differently, these companies do not have any right to use the identifiable information we provide to them beyond what is required by your request.

ADS does not control, partner with, or have special relationships with any third party advertisers, links or sites. The owners of any unrelated web sites, such as third party online retailers, advertisers, or unrelated sites that the Site may happen to link to, or web sites that link to the Site, may collect personal information directly from you. The information policies and practices of these unrelated parties are not covered by this Privacy Policy. ADS does not control the privacy policies of third parties, advertisers, sponsors of other sites, or businesses, even if the Site may provide hyperlinks or other access to their web sites. ADS is not responsible or liable for such third parties’ independent policies and practices. Please note that when you voluntarily disclose personal information in emails, blogs or other online resources, any of that disclosed information may be collected by others.

This site may utilize cookies. A cookie is a small text file that a website can place on your computer hard drive in order to collect information about your activities and your IP address used on the website. Because cookies allow you to take advantage of some of the Site’s essential features, such as your stored shopping cart, we recommend that you leave them turned on. ADS uses the industry standard encryption protocol known as Secure Socket Layer (SSL) to keep your information secure. ADS has taken every reasonable precaution to fully protect all your sensitive personal information by using a secure 128-bit encryption online ordering system. When you enter a secure page, you will see the SSL Secured (128 Bit) icon at the bottom of your browser. This icon signifies that, for your safety, any personal information you enter online is encrypted.

On the bottom of your web browser you will see a padlock or similar image (depending on your browser), which is in what appears to be a locked position.

The beginning of the web address in your web browser will always begin with “https://”. Traditionally a web address begins with “http”. The added “s” stands for security.

ADS will make all reasonable offers not to offer less than 128-bit encryption. If you get an error message telling you that you need a browser that supports 128-bit encryption, you must upgrade your browser. See your browser help files for more information.

ADS may amend this Privacy Policy from time to time. If ADS makes any substantial changes in the way it uses your personal information, ADS will notify you by posting a prominent announcement on the Site.

If your personal information needs to be updated, please go to your account and update your information accordingly.

This Site is not intended for minors. ADS does not knowingly collect personally identifiable information from children under 18 years of age. If you are a minor, you are not authorized to use this Site or to provide us information. If you learn of any submission of personal information to the Site that may be subject to the Children’s Online Privacy Protection Act, please contact ADS as soon as possible or email the circumstances to us at the contact information below.

All content included or otherwise embedded or incorporated on this Site, including without limitation, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of ADS, its licensors or suppliers and protected by intellectual property laws. Atlantic Diving Supply, ADS, and all other trade names, trademarks, service marks, graphics, logos, and service names are the marks or trade dress of ADS. Our content, marks and trade dress may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits ADS. All other marks not owned by ADS that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by ADS. Any rights not expressly granted herein are reserved.

You agree to indemnify, defend and hold ADS harmless, including ADS’ officers, directors, employees, agents, affiliates, licensors and suppliers from and against losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from your violation of this Privacy Policy, Terms of Use or other terms and conditions governing the request for information or ordering of products or services from ADS (collectively, this “Agreement”), or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site using your internet account.

ADS reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of this Agreement. You agree that no joint venture, partnership, employment, or agency relationship exists between you and ADS as a result of this Agreement, or use of the Site. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth in the Terms of Use, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this Agreement shall continue in effect.

Any and all claims or disputes relating to or arising from your use of this Site or the information, content, products, services, or materials on the Site or otherwise provided by ADS through your use of the Site, or the interpretation and enforcement of this Agreement shall be governed by the laws of the Commonwealth of Virginia, as it applies to a contract executed, delivered and performed solely in Virginia, and without regard to any conflict of law provisions. Any action or proceeding seeking to enforce any provision of, or based on any right arising out of, this Agreement shall be brought against either of the parties only in the courts of the commonwealth of Virginia, located in the city of Virginia Beach or, if it has or can acquire jurisdiction, in the United States District Court for the Eastern District of Virginia, Norfolk Division, and you and ADS hereby consent to the exclusive jurisdiction and venue of such courts (and of the appropriate appellate courts) in any such action or proceeding and irrevocably waive any objection to such jurisdiction and venue. Process in any action or proceeding referred to in the preceding sentence may be served anywhere in the world. Your use of the Site does not subject us to any judicial process or to the jurisdiction or venue of any courts or tribunals other than those identified above, including without limitation, those in your jurisdiction or location.

This Agreement and any sale or account terms, all of which are incorporated herein (and are available for review), constitute the entire agreement between you and us regarding your use of this Site and the materials, services and products provided to you by ADS through your use of the Site. The failure to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.
